Terms & Conditions

Please read these terms carefully before using the LEHSFF·CAFI Incubation Programme platform. By accessing or using our services you agree to be bound by these terms.

Important Notice
These Terms and Conditions govern your access to and use of the LEHSFF·CAFI Incubation Programme portal, including all applications, reporting tools, and communication features. They apply to entrepreneurs, Enterprise Support Organisations (ESOs), evaluators, and all other registered users.

Acceptance of Terms

By registering an account, submitting an application, or otherwise accessing the LEHSFF·CAFI Incubation Programme platform (the "Platform"), you confirm that you have read, understood, and agree to be legally bound by these Terms and Conditions ("Terms").

If you do not agree to these Terms in their entirety, you must not access or use the Platform. Your continued use of the Platform following any amendment to these Terms constitutes your acceptance of the revised Terms.

If you are accepting these Terms on behalf of an organisation, you represent and warrant that you have the authority to bind that organisation to these Terms.

Eligibility

To be eligible to register and participate on the Platform, you must:

  • Be at least 18 years of age at the time of registration
  • Be a citizen or legally registered entity within the Kingdom of Lesotho
  • Provide accurate, current, and complete information during registration
  • Not have been previously suspended or removed from the Platform
  • Have a valid email address and means of electronic communication
  • Comply with all applicable local, national, and international laws and regulations

For ESOs, eligibility additionally requires approval by the LEHSFF·CAFI programme management team and maintenance of an active, valid operating licence throughout your participation.

Platform Use

You agree to use the Platform only for its intended purposes. The following uses are strictly prohibited:

  • Submitting false, misleading, or fraudulent information in any form
  • Attempting to gain unauthorised access to other user accounts or system areas
  • Using automated tools, bots, or scrapers to extract Platform data
  • Transmitting viruses, malware, or any code designed to harm the Platform
  • Harassing, abusing, or threatening other users of the Platform
  • Using the Platform for any commercial purpose not explicitly authorised by LEHSFF·CAFI
  • Impersonating any person or entity, or misrepresenting your affiliation
  • Interfering with or disrupting the integrity or performance of the Platform
Violations of these usage rules may result in immediate account suspension, permanent ban, and referral to appropriate law enforcement authorities.

Applications & Submissions

All applications submitted through the Platform are subject to the eligibility criteria and evaluation processes established by the LEHSFF·CAFI programme. By submitting an application you acknowledge and agree that:

  • All information provided in your application is truthful, accurate, and complete
  • Once submitted, applications cannot be withdrawn except in exceptional circumstances and only with explicit written approval from programme management
  • LEHSFF·CAFI reserves the right to request additional documentation or information at any stage of the evaluation process
  • Selection decisions are final and at the sole discretion of the evaluation panel
  • You grant LEHSFF·CAFI a non-exclusive licence to use submitted materials for the purpose of evaluating your application
  • Draft applications that remain unsubmitted after a call closing date will be automatically archived and no longer eligible for consideration
Tip: Save your application as a draft frequently and review all sections before final submission. Submitted applications cannot be edited.

Data & Privacy

LEHSFF·CAFI is committed to protecting your personal information. By using the Platform, you consent to the collection, processing, and use of your data as described below and in our Privacy Policy.

We collect and process the following categories of data:

  • Identity data — name, date of birth, gender, nationality
  • Contact data — email address, phone number, physical address
  • Business data — company details, financial information, sector
  • Usage data — login activity, feature usage, report submissions
  • Communication data — emails sent through the Platform, notifications

Your data will not be sold to third parties. It may be shared with authorised programme partners, funders (including CAFI), and regulatory bodies as required by law or programme governance obligations. All data is stored securely and retained for a period not exceeding seven (7) years following the conclusion of the programme, unless otherwise required by law.

You have the right to access, correct, or request deletion of your personal data by contacting the Data Protection Officer at the address provided in Section 12.

Intellectual Property

All content, design, software, trademarks, and materials on the Platform are the intellectual property of LEHSFF·CAFI or its licensors and are protected by applicable copyright, trademark, and intellectual property laws.

You retain ownership of any intellectual property contained in your application submissions. By submitting content to the Platform, you grant LEHSFF·CAFI a worldwide, royalty-free, non-exclusive licence to:

  • Use, display, and reproduce your submissions for programme evaluation purposes
  • Share anonymised or aggregated data derived from submissions for reporting to funders
  • Feature anonymised success stories in programme communications and publications, subject to your prior written consent

You must not reproduce, distribute, or create derivative works from Platform content without explicit written permission from LEHSFF·CAFI.

ESO Responsibilities

Enterprise Support Organisations (ESOs) approved to participate in the programme accept additional obligations over and above the general terms applicable to all users:

  • Maintain active and professional support relationships with all assigned enterprises
  • Submit accurate and timely reports through the Platform on behalf of enterprises under their incubation
  • Ensure that monthly performance reports submitted by incubated enterprises reflect true and verifiable data
  • Notify LEHSFF·CAFI management promptly of any enterprise that is no longer operational or has materially changed its business activities
  • Keep all enterprise data shared through the Platform strictly confidential
  • Not assign, sub-licence, or transfer any obligations under this agreement to any third party without prior written consent
ESOs found to have submitted falsified or materially inaccurate data may be removed from the programme and may be subject to recovery of any funds disbursed on the basis of such data.

Programme Participation

Participants in the LEHSFF·CAFI Incubation Programme agree to:

  • Submit monthly performance reports by the designated deadline each month
  • Attend mandatory programme sessions, workshops, and review meetings
  • Cooperate with programme-appointed mentors, evaluators, and due-diligence teams
  • Maintain up-to-date contact information on the Platform at all times
  • Promptly disclose any material change in the business, ownership structure, or operating circumstances to programme management
  • Not receive duplicative funding from other LEHSFF or CAFI supported instruments without prior written disclosure and approval

LEHSFF·CAFI reserves the right to amend programme requirements, timelines, and deliverables at any time. Participants will be notified of significant changes through the Platform and by email.

Limitation of Liability

To the fullest extent permitted by applicable law, LEHSFF·CAFI, its officers, employees, agents, and funders shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, revenue, data, or business opportunities
  • Interruption or unavailability of the Platform
  • Errors, omissions, or inaccuracies in Platform content
  • Unauthorised access to or alteration of your data
  • Decisions made by evaluation panels in respect of applications

The Platform is provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied, including but not limited to fitness for a particular purpose or non-infringement.

Termination

LEHSFF·CAFI reserves the right to suspend or terminate your access to the Platform at any time, with or without notice, for any of the following reasons:

  • Breach of any provision of these Terms
  • Provision of false or misleading information
  • Conduct that is harmful to other users, the programme, or LEHSFF·CAFI's reputation
  • Failure to meet programme reporting or participation obligations for a period exceeding three consecutive months
  • Insolvency, dissolution, or cessation of business operations

Upon termination, your right to access the Platform ceases immediately. Data associated with your account will be retained in accordance with our data retention policy described in Section 5. You may request a copy of your data within 30 days of termination.

Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Lesotho. Any dispute arising out of or in connection with these Terms that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the courts of the Kingdom of Lesotho.

Before initiating formal legal proceedings, both parties agree to attempt resolution through good-faith negotiation for a period of no less than thirty (30) days following written notice of the dispute.

If you have a complaint about the Platform or these Terms, please contact us in the first instance using the details in Section 12. We aim to acknowledge all complaints within five (5) business days.
